Principle of legality, loyalty, and transparency: We will always require your consent for the treatment of your personal data for one or more specific purposes, about which you will be informed in advance with absolute transparency. 

Principle of data minimization: We will only ask for strictly necessary data in relation to the purposes for which it is needed. 

Principle of limitation of the period of conservation: the data will be kept only for the time that it strictly necessary to carry out the purposes of its treatment, or until you revoke your consent. Depending on the purpose for which the data was requested, we will inform you of the corresponding conservation period. In the case of subscriptions, we will periodically review our lists and delete those records that have been inactive for a considerable time. 

Principle of integrity and confidentiality: Your data will be treated in such a way as to ensure adequate security or your personal data and its confidentiality. We will take all necessary precautions to avoid unauthorized access or improper use of our users’ data by third parties.

Interested parties can access their personal data, as well as request the rectification of incorrect data or, if necessary, request its deletion when, among other motives, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, interested parties can request the limitation of their data use, in this case it will only be kept for the exercise or defence of claims.

In certain circumstances and for reasons related to their particular situation, interested parties can oppose the use of their data. PEN Català will no longer use the data, except for compelling legitimate grounds, or the exercise or defence of possible claims. As the interested party, you have the right to request the personal data that concerns you, which you have provided us in a structured format, in common use and legible format, in order to transmit to another person responsible for its treatment when:

  • The data was facilitated by the interested party.

In exercising your right to the portability of data, you will have the right for the personal data to be transmitted directly to and from the person in charge, where technically possible. 

Interested parties will also have the right to effective judicial protection and to submit a complaint to the controlling authority, in this case, the Spanish Agency for Data Protection, if they consider that the processing of personal data concerning them infringes the regulation. 

For what purposes do we use your personal data?

When a user connects to our website, for example to send an email to the owner, to subscribe, or to participate, he or she is providing information of a personal character, for which PEN Català is responsible. This information can include personal information such as your IP address, name, physical address, email address, phone number, and other information. In providing this information, the user gives his or her consent for the information to be compiled, used, managed and stored by PEN Català, only as described in the Legal Notice (see below) and the present Privacy Policy.

We request this information to respond to the requirements of the users who get in touch with us, for example, to respond to questions, complaints, comments or concerns regarding the information included on the website, the services provided through the website, the treatment of your personal data, questions regarding legal texts included on the website, as well as any other queries that you may have and that are not subject to the contractual conditions. 

The data you provide will be stored on the Siteground servers (PEN Català service provider). Siteground is located in the EU, in a country with a suitable level of protection according to the European Commission. 

Form for subscribing to the newsletter: In this case, we ask for the following personal data:

The data is provided by the user when making the subscription. Data is requested to manage the subscription list and send newsletters. There are several forms on the website to activate the subscription. The newsletters are managed by Mailchimp. The data provided will be located on Mailchimp servers (PEN Català service provider), outside the EU, in the USA. Mailchimp is hosted by the EU-US Privacy Shield, approved by the European Data Protection Committee, information available here.

The information collected will allow us to contact you for the possible inclusion of the case in our database. Requests will be responded to by email. 

The data you provide are located on the servers of Google (service provider for PEN Català). Google, Inc. is a company from Delaware, whose main office is found at 1600 Amphitheatre Parkway, Mountain View (California), CA 94043, United States (“Google”).

Other purposes exist for which we use your personal data: 

To guarantee the fulfilment of the conditions of use and the applicable law. This may include the development of tools and algorithms that help this website guarantee the confidentiality of the personal data it collects. 

To support and improve the services offered by this website. Other non-identifying data is also collected using cookies, which are downloaded to the user’s computer when her or she surfs on the web, and which is detailed in the cookies policy (see below).

To manage social media. PEN Català is present on social media networks. The treatment of personal data of those who decide to follow us on social media through the official pages of our website is governed by this section. So are the conditions of use, privacy policies and access regulations that belong to the social network that apply in each case and that have been previously accepted by the PEN Català user. The data will be used with the purpose of properly managing their presence on the social network, informing them of PEN Català’s activities, products, or services, as well as for any other purpose allowed by the regulations of the social networks. In no case will the profiles our social media followers be used to send individual advertising.

PEN Català does not sell, rent, or transfer personal data that can identify the user, nor will it do so in the future, to third parties without previous consent. The highest standards of security will always be employed.

In browsing our website non-identifying data can be collected, which can include IP addresses, (approximate) geographic location, a record of how services and sites are used, and other data that cannot be used to identify the user. Included in the non-identifying data is also that related to browsing habits through third-party services.

PEN Català cannot guarantee the absolute infallibility of the internet and therefore the violation of the data by third parties through fraudulent means. 

With regard to the confidentiality of the process, PEN Català must ensure that any person who is authorized by PEN Català to process users’ data (including its employees, collaborators, and lenders) will be under the appropriate obligation of confidentiality (whether contractual or legal). 

In the case of a security incident, upon becoming aware of it, PEN Català must notify the user without undue delays and must provide timely information regarding the security incident, as it is known or when the user reasonably requests it.

We do not send SPAM

In accordance with LSSICE, PEN Català does not engage in SPAM practices, so it does not send commercial emails that have not been previously requested or authorized by the user. Consequently, in each of the forms hosted on the website, the user has the possibility to give his or her consent to receive the newsletter, regardless of the contact information requested.
